These terms and conditions constitute a legally binding agreement between you, the user, and Tip and Tap Designing Programs & Applications, the owner and operator of the Quokka Mesh application. This smart application is an innovative platform for social networking and sending greetings of various kinds, offered 100% free of charge. By using this application, you acknowledge and agree to be fully bound by these terms and conditions. If you do not agree to any of these terms, please cease using the application immediately.
The user agrees to indemnify and hold the company harmless from any claims, losses, damages, or expenses, including legal fees, arising from or related to the user's use of the application.
The company reserves the right to modify or update these terms and conditions as necessary. Users will be notified of any material changes before they take effect. Continued use of the application after modifications implies acceptance of the amended terms
These terms and conditions are governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Dubai
The company reserves the right to terminate or suspend the user's access to the application at any time without prior notice in the event of any breach of these terms and conditions or for any other reason deemed justified by the company
The company shall not be liable for any delay or failure to perform its obligations under these terms and conditions if such delay or failure is due to circumstances beyond its reasonable control, including but not limited to natural disasters, wars, terrorism, government regulations, or disruptions in communication services
In no event shall the company’s total liability to the user exceed the amount of fees, if any, paid by the user to the company for using the application during the six months preceding the incident that gave rise to the claim
In the event of any dispute arising from the use of the application, the parties shall seek to resolve it amicably. If an amicable resolution is not possible, the dispute shall be referred to arbitration in accordance with the rules of the Dubai International Arbitration Centre
